Welcome to Ariavon. The terms “we”, “us”, and “our” refer to EVOLVORO LTD, trading as Ariavon (“Ariavon”). We operate this store and website, including all related information, content, features, tools, products, and services (collectively, the “Services”).

We reserve the right to change product descriptions, pricing, limits, offers, or availability at any time, without notice. We may limit or stop the sale of any product to any person, region, or jurisdiction at our discretion.

1. ORDERS
   When you place an order, you are making an offer to purchase. We reserve the right to accept or reject any order at our sole discretion, including after the order has been submitted and payment details provided.

Your order is only accepted once we confirm it. We may cancel or refuse any order for any reason, including suspected fraud, address issues, lack of stock, or regulatory reasons. If we cancel or modify an order, we will attempt to notify you using the contact details you provided when ordering.

Please review your order carefully before submitting it. We may not be able to stop or modify an order once it has been processed.

Returns and exchanges are only allowed in accordance with our Return & Refund Policy.

You confirm that the products you purchase are for personal or household use only and not for resale or export.

1. PRICING AND BILLING
   Prices, promotions, and discounts may change at any time, without notice. The price charged for a product is the price displayed at checkout at the time your order is placed, and will be confirmed in your order confirmation email.

Unless clearly stated otherwise, prices shown do not include taxes, import duties, customs fees, handling fees, or shipping costs. These may be added at checkout or charged separately by carriers or customs.

We may offer promotional campaigns from time to time. If there is a conflict between the terms of a specific promotion and these Terms, the promotional terms apply to that promotion.

   All delivery times shown are estimates and not guarantees. We are not responsible for delays caused by carriers, customs processing, or events outside our control.

Ownership and risk of loss transfer to you when the order is handed over to the shipping carrier.

You are responsible for providing a correct and complete delivery address. We are not liable for lost packages or failed delivery if the address you provided is incomplete or incorrect.

1. INTELLECTUAL PROPERTY
   All content included in the Services — including but not limited to trademarks, brand names, text, images, graphics, product reviews, video, audio, page layout, and design — is owned by us, our affiliates, or our licensors, and is protected by intellectual property laws.

Trademarks, logos, and brand elements of Shopify belong to Shopify. All other trademarks are the property of their respective owners.

1. RELATIONSHIP WITH SHOPIFY
   Our store is hosted by Shopify, which provides the e-commerce platform that allows us to sell our products and services to you.

All sales, orders, and transactions are between you and us, not between you and Shopify. By using the Services, you acknowledge and agree that Shopify is not responsible for your purchase, for product safety, for delivery, or for any damages related to your order. You expressly release Shopify and its affiliates from any claims related to your transactions with us.

If we terminate your access, you remain responsible for any amounts owed up to and including the date of termination.

Sections that by their nature should survive termination (including Intellectual Property, Feedback, Limitation of Liability, Indemnification, Governing Law, and others) will continue to apply after termination.

1. DISCLAIMER OF WARRANTIES
   Unless expressly stated by us in writing, the Services and all products offered through the Services are provided “as is” and “as available”, without warranties of any kind, either express or implied.

We do not guarantee that the Services will be uninterrupted, secure, timely, error-free, or that any defects will be corrected. You agree that your use of the Services is at your own risk.

You agree that our total aggregate liability to you for any claim arising out of or relating to these Terms or the Services shall not exceed the total amount you paid to us for the product or service giving rise to the claim.

   You agree to defend, indemnify, and hold harmless EVOLVORO LTD (Ariavon), Shopify, and our respective affiliates, officers, directors, employees, agents, contractors, service providers, and licensors from and against any claims, losses, liabilities, damages, costs, or expenses (including reasonable legal fees) arising out of or related to:

   (b) your violation of any law or the rights of any third party, or
   (c) your use of the Services.

We may, at our own expense, assume the exclusive defense and control of any matter subject to indemnification. You agree to cooperate with us in asserting any available defenses.

1. SEVERABILITY
   If any provision of these Terms is found to be unlawful, void, or unenforceable, that provision shall be enforced to the maximum extent permitted by law, and the unenforceable portion shall be deemed severed from these Terms. The remainder shall continue in full force and effect.

2. ENTIRE AGREEMENT / NO WAIVER
   These Terms, together with any policies posted on the website (including the Privacy Policy and Return & Refund Policy), constitute the entire agreement between you and us.

If we do not enforce a right or provision under these Terms, that does not mean we waive that right or provision.

Any ambiguity in the interpretation of these Terms shall not be construed against the drafting party.

   You may not assign, transfer, or delegate your rights or obligations under these Terms without our prior written consent. Any attempted assignment by you without consent is void.

We may assign, transfer, or delegate any of our rights and obligations under these Terms at any time, without notice.

1. GOVERNING LAW AND JURISDICTION
   These Terms, and any dispute or claim arising out of or related to them, are governed by and interpreted in accordance with the laws of the jurisdiction in which EVOLVORO LTD has its registered headquarters, without regard to conflict of law rules.

You and we agree that the courts of that jurisdiction shall have exclusive (or where applicable, non-exclusive) jurisdiction over any dispute.

We reserve the right, at our sole discretion, to update, change, or replace any part of these Terms. If we make material changes, we will provide notice in accordance with applicable law. Your continued use of the Services after changes are posted means you accept those changes.
